Birla Punya is a residential project developed and promoted by Birla Estates. The project consists of 1 BHK, 2 BHK, 2 BHK XL, 3 BHK, 3.5 BHK XL, and 4.5 BHK residences. The project is spread over 5+ acres with approximately 70% open green spaces and includes over 50 lifestyle amenities. All specifications, designs, and plans are subject to change or modification at the discretion of the developer or as directed by the competent authorities.
A booking amount must be paid to reserve a unit. The booking will be confirmed upon receipt of the booking amount and signing of the agreement to sell. The payment schedule will be outlined in the agreement to sell and must be strictly adhered to by the purchaser. All payments must be made via approved banking channels (cheque, demand draft, or electronic transfer) in favor of the developer. Any delay in payment may result in penalties or cancellation of the booking at the developer’s discretion.
The possession of the unit will be delivered upon completion of the project and after securing all necessary approvals and clearances from the concerned authorities. The estimated possession date is subject to changes based on unforeseen circumstances, force majeure events, or delays in regulatory approvals. Prior to possession, all outstanding dues, including maintenance charges and registration fees, must be cleared by the purchaser.
In the event of cancellation by the purchaser, the booking amount and any payments made may be subject to deductions as outlined in the agreement to sell. The developer reserves the right to cancel the booking in case of non-compliance with the payment schedule or any breach of contract terms. Refunds (if applicable) will be processed within 60 days from the date of cancellation.
A maintenance deposit or advance may be required at the time of possession to cover common area maintenance and facilities management. The formation of a resident welfare association (RWA) will take place post-possession, and all residents will be required to comply with the association's rules and guidelines. Maintenance charges will be levied periodically as per the terms defined by the RWA or the property management company.
No structural changes, external modifications, or alterations to the unit will be permitted without the prior written consent of the developer and relevant authorities. Any unauthorized changes made by the purchaser will be at their own risk and expense.
The purchaser shall comply with all local laws, building regulations, and society rules applicable to the project. All disputes arising out of or related to this agreement will be subject to the jurisdiction of the courts in Pune.
The developer will not be liable for any indirect, consequential, or incidental damages arising out of the purchase or use of the unit. The purchaser agrees to indemnify and hold the developer harmless from any claims or disputes arising from third-party actions or legal requirements.
